1. Platform Nature & Intermediary Status

PushCartSiren operates as an electronic technology intermediary as defined under Section 2(1)(w) of the Information Technology Act, 2000. PushCartSiren is a technology discovery platform that connects mobile street pushcart vendors, local neighborhood businesses, and residential households.

PushCartSiren is not a direct merchant, buyer, or seller of goods. We do not manufacture, inspect, package, or warrant the quality, freshness, or weights and measures of goods traded directly in person between vendors and consumers.

3. Kirana & Cafe POS Billing & Khata Terms

PushCartSiren provides the Kirana Shop POS application for Kirana store owners, small retail merchants, cafes, tea stalls, juice centers, and tiffin providers. Terms specific to POS and Khata usage include:

• Owner & Staff Accounts: Shop owners are responsible for maintaining the confidentiality of their 4-digit Owner PIN and secret Private Shop Code.
• Counter Billing & Pricing: Store owners set their own retail selling prices and product categories. For packaged goods, selling prices must comply with Legal Metrology MRP guidelines under applicable Indian laws.
• Prepared Food & Beverages (Tea, Coffee, Idli, Dosa): Store owners utilize the bulk costing and raw material expense tracking feature to monitor Net Profit. PushCartSiren does not inspect or guarantee food preparation quality.
• Udhar Khata & WhatsApp Statements: Store owners entering customer credit entries and sharing statements via WhatsApp guarantee that customer details are recorded solely for legitimate business billing and ledger settlement.

2. Rule 3(1) Due Diligence & Prohibited User Content

In accordance with Rule 3(1)(b) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, users, vendors, and advertisers are strictly prohibited from hosting, displaying, uploading, modifying, publishing, transmitting, storing, updating, or sharing any information that:

• Belongs to another person and to which the user does not have any right;
• Is defamatory, obscene, pornographic, pedophilic, invasive of another's privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, or encouraging money laundering or gambling;
• Is harmful to children or minors;
• Infringes any patent, trademark, copyright, or other proprietary rights;
• Deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or false or misleading information;
• Threatens the unity, integrity, defense, security, or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognizable offense;
• Contains software viruses or any other computer code designed to interrupt, destroy, or limit the functionality of any computer resource;
• Violates any law for the time being in force in India.

3. Street Vendors Act, 2014 Recognition

PushCartSiren operates in full recognition of the rights recognized under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014. We provide our proximity discovery tools completely free of charge to informal street vendors, empowering their micro-livelihoods and integrating them with digital public infrastructure.

4. Disclaimer of Warranties & Limitation of Liability

The platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied. Under no circumstances shall PushCartSiren, its directors, officers, or affiliates be liable for any indirect, incidental, punitive, or consequential damages resulting from in-person transactions between buyers and sellers on the street.

5. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of India. Any legal dispute or proceeding arising out of or related to these Terms shall be subject to the exclusive jurisdiction of the competent courts in India.
